Description

Modern data protection in the EU law is founded on European law. Privacy is protected by the European Convention on Human Rights and a right to the protection of personal data is recognised in the Charter of Fundamental Rights of the European Union. Numerous high-profile cases on data protection have come before the Court of Justice of the European Union. The GDPR is also a part of EU law. This module will examine the history of privacy in the EU and the foundations of modern data protection law. It will analyse the major relevant case law on data protection and will provide students with a systematic understanding of the GDPR and its legal and practical consequences.

Learning Outcomes

1. Critically evaluate the General Data Protection Regulation, it’s potential impact on business, consumers, internet users and public bodies.
2. Analyse and have a systematic understanding of European privacy law including privacy under the European Convention on Human Rights and right to the protection of personal data under the Charter of Fundamental Rights of the European Union.
3. Critically assess the relevant case law on data protection and privacy.
4. Analyse and have a systematic understanding of the rights of data subjects including the right to information, right of access, right to rectification and the right to be forgotten.
5. Analyse the key challenges of protecting privacy rights and enforcing the General Data Protection Regulation.

An Introduction to EU data protection law; The right to privacy in the European Union and the relevant case law; The right to Data Protection and Article 8 of the European Convention on Human Rights and relevant case law; The scope and application of the General Data Protection Regulation including consent, notification requirements, sensitive data, notification requirements; The rules of data processing under the General Data Protection Regulation; The rights of the data subject under General Data Protection Regulation; International data transfers under the GDPR; The legal obligations of data controllers and processors. The Irish Data Protection Commission and the role of data protection officers; Remedies, Liabilities and Penalties for breaches of privacy rights Privacy by design, anonymisation and pseudonymisation.
