Description

On completion of this module, students will understand the applicable international commercial arbitration law. Students will be familiar with the range of alternative dispute resolution methods and comprehend the differences between arbitration, conciliation, litigation, mediation and negotiation. Students will acquire a critical knowledge and comprehension of the domestic and international legal rules and treaties governing the use of international commercial arbitration, including comprehension of the scope and effect of arbitration agreements, the role and functions of the arbitrator(s) and arbitral tribunal, and the recognition and enforcement of arbitral awards.

2. L02 Explain the fundamental rules of international commercial arbitration with reference to applicable legislation and case law
3. L03 Demonstrate knowledge and critical understanding of the underlying principles of international commercial arbitration law and how these impact the conduct of the arbitration process and awards
4. L04 Assess how arbitration is used in an international business and commercial context
5. L05 Evaluate problem scenarios with reference to case law, legislation and academic literature
