Description

This course will survey approaches to privacy law around the globe. Students taking this course will have already studied EU Data Protection law and this module will serve to provide students with a systematic understanding of alternative regulatory approaches to data protection and privacy law. The US will serve as the primary comparative jurisdiction. However, additional jurisdictions will also be considered including China, Australia, Canada and Brazil.

Learning Outcomes

1. Critically evaluate the General Data Protection Regulation, it’s potential impact on business, consumers, internet users and public bodies.
2. Analyse and have a systematic understanding of US privacy law, including federal laws such as the Electronic Communications Privacy Act (18 USC 2510) and the Federal Trade Commission Act (15 USC 41-58).
3. Critically assess leading US and international case law on data protection and privacy.
4. Analyse and have a systematic understanding of leading state law such as the California Consumer Privacy Act 2018.
5. Analyse the key challenges of protecting privacy rights and enforcing the General Data Protection Regulation.
