Description

INACTIVE - This module examines the historical development of the rules of equity in light of the development of the common law; in particular it looks at the development of the trust. It focuses on the substantive rules of law relating to the creation and regulation of trusts considers the role of the trust device in a modern legal system.

Learning Outcomes

1. describe and outline the distinction between the common law and equity
2. describe and outline the complex rules relating to the creation, operation and interpretation of trusts and the role of trustees
3. Appraise the role of the trust as a remedial device in commercial matters
4. Explain and evaluate complex primary sources of law relating to the trust
5. Apply the law to factual situations and construct an effective argument
