Description This module is concerned with the recognition and exploitation of legal rights in intellectual property. The module will cover the following areas: the common law action in passing off; registration and infringement of trade marks under the Trade Marks Act 1996; parallel importation and the exhaustion of trade mark rights; criteria for patentability under the Patents Act 1992; patent infringement; protection of copyrights in literary, artistic works, films, sound recordings, and broadcasts; protection of legal rights in databases. | |||||||||||||||||||||||||||||||||||||
Learning Outcomes 1. Identify the legal regulation of the exploitation of ideas, innovation and artistic endeavours 2. Locate Irish intellectual property law within its European and international contexts 3. Apply principles of intellectual property law to problems relating to patents, copyrights, trademarks and design rights. 4.
